Welcome to DesignerPK. These Terms & Conditions govern your use of www.designerpk.com and your engagement with DesignerPK for web development, web design, AI engineering, automation, maintenance, and related digital services.

By using this website or engaging our services, you agree to these Terms & Conditions.

1. About DesignerPK

DesignerPK is the professional brand of Irfan Ahmed, an independent web developer, web designer, and AI engineer providing digital solutions including website development, web applications, AI automation, integrations, optimization, maintenance, and technical support.

2. Services

DesignerPK may provide services including:

  • Website design and development
  • WordPress and eCommerce development
  • PHP development
  • Node.js development
  • React and Next.js applications
  • Website bug fixing and troubleshooting
  • Website speed and performance optimization
  • Security remediation
  • API and third-party integrations
  • AI engineering and automation solutions
  • Website maintenance and technical support

The exact scope, deliverables, timeline, revisions, and pricing for each project will be discussed and confirmed in writing, such as by email, proposal, invoice, or project agreement, before or during the start of the engagement.

3. Project Requirements & Client Responsibilities

Clients are responsible for:

  • Providing accurate information and project requirements
  • Providing required content, images, logos, branding materials, and documents
  • Providing necessary access, such as hosting, website administration, API credentials, or other technical access
  • Maintaining their own backups in addition to any backups provided by DesignerPK
  • Reviewing and approving work within a reasonable timeframe
  • Maintaining reasonable communication throughout the project

Delays caused by missing information, access, approvals, content, or other materials required from the client may affect the project timeline.

4. Project Timeline

Estimated project timelines are provided as guidance and are based on the agreed scope.

Completion times may vary depending on:

  • Project complexity
  • Client requirements
  • Availability of required content and access
  • Communication and approval times
  • Number of revisions
  • Third-party services or dependencies
  • Changes to the original project scope

Any significant change to the project scope may result in an adjusted timeline.

Where client feedback, approval, content, access, or other input is required to proceed, project timelines may be extended accordingly. DesignerPK is not responsible for delays resulting from delayed, incomplete, or unavailable client feedback, approvals, content, access, or other required materials.

5. Quotes, Pricing & Payments

Project pricing depends on the type, size, complexity, and requirements of the work.

One-time projects may be quoted at a fixed price based on the agreed scope. Maintenance or support plans may be billed monthly or according to the applicable agreement.

Payment terms, milestones, deposits, and pricing will be confirmed before work begins.

For custom projects, work may begin after receipt of the agreed initial payment.

Payments for completed work are subject to the agreed project terms. Where a project is cancelled after work has started, the client may be responsible for payment for work completed up to the date of cancellation.

If an agreed payment becomes overdue, DesignerPK may pause or suspend work, maintenance, support, or other services until the outstanding amount is paid. DesignerPK may also withhold delivery of unfinished or unpaid deliverables where permitted by the applicable project agreement. Any resulting delay to the project timeline will not be considered a delay caused by DesignerPK.

6. Revisions & Scope Changes

Projects include revisions according to the agreed proposal, package, or project scope.

Requests that expand the original scope—including additional pages, features, functionality, integrations, or work relating to newly discovered issues—may require:

  • An additional charge
  • A revised quotation
  • An adjusted delivery timeline

DesignerPK will communicate significant additional work and, where reasonably possible, obtain client approval before proceeding.

Work outside the agreed scope will not be considered included merely because it is related to the original project. Additional work may require separate approval, pricing, and timeline adjustments.

7. Warranty on Bug Fixes

Unless otherwise agreed in writing, website bug-fixing work includes a 14-day warranty limited to the specific issue addressed by DesignerPK.

If the exact same issue fixed by DesignerPK reoccurs within 14 days of delivery, DesignerPK will make reasonable efforts to fix that issue again at no additional charge.

This warranty applies only to the specific issue originally fixed by DesignerPK and does not constitute a warranty for the website as a whole or for unrelated functionality, performance, security, compatibility, or future issues.

This warranty does not cover:

  • New or unrelated issues
  • Changes made by the client or another developer
  • Changes to hosting, plugins, themes, APIs, or third-party services
  • Issues caused by software or services outside DesignerPK’s control
  • New requirements or functionality

8. Website Content & Client-Provided Materials

Clients are responsible for ensuring that they have the legal right to use all content, images, logos, documents, fonts, videos, software, and other materials supplied to DesignerPK.

The client remains responsible for any claims arising from materials provided by the client.

9. Intellectual Property & Ownership

Upon full payment, ownership of custom code, designs, and other original deliverables created specifically for the client’s project will transfer to the client, unless otherwise stated in the project agreement.

This transfer does not include:

  • Third-party software or plugins
  • Open-source software and its applicable licenses
  • Licensed fonts, images, graphics, or other assets
  • Third-party APIs or services
  • AI platforms or external software
  • Pre-existing DesignerPK code, tools, frameworks, libraries, templates, or systems
  • Materials that DesignerPK does not own

Third-party components remain subject to their respective licenses and terms.

10. Third-Party Services

Projects may depend on third-party services, including:

  • Hosting providers
  • Domain registrars
  • Payment gateways
  • WordPress plugins and themes
  • APIs
  • AI platforms
  • Cloud services
  • External software and integrations

Clients are responsible for applicable third-party fees, accounts, subscriptions, usage charges, and compliance with third-party terms.

DesignerPK is not responsible for outages, pricing changes, policy changes, limitations, security incidents, or failures of third-party services that are outside DesignerPK’s reasonable control.

11. AI Services & Automation

AI solutions and automation workflows are developed using available technologies and according to the agreed project requirements.

AI-generated results may vary depending on the quality of data, models, APIs, integrations, configuration, and other factors.

Clients are responsible for reviewing and validating AI-generated content or outputs before relying on them for important business, financial, legal, medical, or other consequential decisions.

DesignerPK does not guarantee that AI-generated outputs will always be accurate, complete, or suitable for a particular purpose.

12. Website Maintenance & Support

Maintenance and support services are provided according to the selected plan or written agreement.

Depending on the plan, support may include:

  • Software and plugin updates
  • Bug fixes
  • Security checks
  • Performance improvements
  • Website monitoring
  • Technical troubleshooting

New development work, major redesigns, additional features, or substantial changes are not included unless specifically stated in the applicable maintenance agreement and may require separate charges.

13. Backups & Data

DesignerPK may create backups or recommend backup procedures when performing certain technical work. However, clients should maintain independent and reliable backups of their websites, databases, files, and other important data.

While reasonable precautions may be taken, DesignerPK cannot guarantee that data loss, corruption, downtime, or other technical problems will never occur.

14. Cancellation

Monthly maintenance or support plans may be cancelled with notice before the next billing cycle, subject to the applicable plan or agreement.

For one-time projects, if a client cancels after work has started, DesignerPK may charge for work completed up to the cancellation date and for any approved or non-refundable third-party expenses.

Any specific cancellation or refund terms agreed upon in writing for a project will take precedence.

15. Limitation of Liability

DesignerPK provides services with reasonable professional care and effort.

To the extent permitted by applicable law, DesignerPK is not responsible for indirect, incidental, special, or consequential losses arising from or related to the services, including losses resulting from:

  • Website downtime
  • Data loss or corruption
  • Hosting or domain provider failures
  • Third-party service failures
  • Client modifications
  • Unauthorized access or security incidents outside DesignerPK’s reasonable control
  • Business decisions made based on digital tools, websites, automation, or AI-generated outputs
  • Changes or failures in external APIs, software, plugins, platforms, or services

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

To the extent permitted by applicable law, DesignerPK’s total aggregate liability arising out of or relating to a particular project shall not exceed the total fees actually paid by the client to DesignerPK for that project.

16. Website Use

You may use the DesignerPK website only for lawful purposes.

You must not:

  • Attempt unauthorized access to the website or its systems
  • Interfere with or damage website functionality
  • Introduce malicious code or harmful software
  • Copy, reproduce, or distribute website content without permission
  • Use the website in a way that violates applicable laws or regulations

17. DesignerPK Intellectual Property

Unless otherwise stated, all original content published on DesignerPK, including text, graphics, branding, designs, website materials, and other original materials, belongs to DesignerPK.

Unauthorized copying, reproduction, modification, or distribution is not permitted without prior written permission.

18. Privacy

Your use of this website is also subject to our Privacy Policy, which explains how personal information may be collected, used, stored, and managed.

19. Formal Agreements

These Terms provide a general framework for DesignerPK’s services.

For projects requiring a formal contract, proposal, statement of work, or other written agreement, the specific signed or otherwise accepted agreement will take precedence over these general Terms to the extent of any conflict.

20. Changes to These Terms

DesignerPK may update these Terms & Conditions when necessary due to changes in services, technology, business practices, or legal requirements.

The updated version will be published on this page with a revised “Last Updated” date.
